Notice of Guangzhou Municipal Commerce Bureau, Guangzhou Municipal Development and Reform Commission and Guangzhou Municipal Administration for Market Regulation on Further Improving and Regulating the List of Charges for Imports and Exports at Guangzhou Ports

All relevant entities,

  To further optimize the business environment of Guangzhou ports, implement the relevant requirements of the Notice of the State Council on Issuing the Work Plan for Optimizing Port Business Environment to Enhance Cross-border Trade Facilitation(Guo Fa [2018] No. 37) and Paragraph 3 of Article 47 of the Regulations of Guangzhou Municipality on Optimizing the Business Environment, Guangzhou Municipal Commerce Bureau, together with Guangzhou Municipal Development and Reform Commission, Guangzhou Municipal Administration for Market Regulation and other entities, have further improved and regulated the list of charges for imports and exports at Guangzhou ports (hereinafter referred to as the "list") in accordance with relevant laws and regulations. The relevant requirements are hereby notified as follows:

  1. The charges for imports and exports at Guangzhouports shall be subject to the list system, and no extra fees shall be charged beyond the list. For the purpose of this Notice, the port charges for imports and exports refer to the charges collected by port operators and related entities that provide services for imports and exports (hereinafter referred to as the "relevant entities") on goods, owners of the goods or their agents in the imports and exports at the ports.

  2. The list shall be managed by category.

  (1) Administrative charges, government-managed funds, and business fees and charges set by the government or set under its guidance. The project name, charging standards, pricing unit, service content, and charging basis of such charges shall comply with relevant policies. See Attachment 1 for the specific list. The list shall, led by the Guangzhou Municipal Commerce Bureau, be made public at China (Guangzhou) International Trade Single Window, promptly adjusted and improved according to the charging policies, updated and published in real time, dynamically managed, and supervised by the public.

  (2) Port service charges regulated by the market. For such charges, an operator shall, in accordance with laws, regulations, rules, regulatory documents and other provisions, independently formulate or adjust the project name, service content and charging standards in light of market demand and competition, and summarize the list of charges. Industry associations are encouraged to formulate industry rules and standards, publish service items and service content provided by operators, and prevent operators from splitting service items or lowering service standards.

  3. Make normative disclosures and accept social supervision. All relevant entities shall disclose their lists, complaint and report hotlines, and other information in prominent places on their business premises and portal websites (or WeChat official accounts and other new network media) in a standardized format (see Attachment 2), and upload the same to China (Guangzhou) International Trade Single Window, which shall summarize and release such information to facilitate inquiries from all walks of life and accept social supervision. A list shall specify the name, service content and charging standards of all the fees charged by an entity. No relevant entities shall charge any unmarked fees beyond the marked prices, impose services or fees by making use of their advantageous positions, charge fees without providing services, or overcharge without providing equivalent services.

  4. The list shall be updated dynamically. If an operator adjustsits charges, it shall update the list published on its business premise and portal website in real time, and simultaneously upload it to China (Guangzhou) International Trade Single Window, which shall adjust the relevant information in a timely manner.

  This Notice shall come into effect as of the date of issuance and shall be valid for 3 years. All relevant entities involved in the imports and exports at Guangzhou ports are requested to comply with and implement this Notice. In case of any problems during the implementation, please report the same to Guangzhou Municipal Commerce Bureau, Guangzhou Municipal Development and Reform Commission and Guangzhou Municipal Administration for Market Regulation.
